Safety First

  • wear life jackets when boating, skiing, on jet skis or swimming in lakes
  • To know basic life-saving techniques, i.e. CPR

While Kentucky’s abundant waterways, private and public pools, and water parks provide endless opportunities for recreation, negligence and/or irresponsible behavior regarding water safety can cause water fun to end in tragedy. According to the Center for Disease Control, there were 3,582 fatal unintentional drownings in the United States in 2005. An additional 710 people died, from drowning and other causes, in boating-related incidents.

Drowning and Boating Accidents
Persons or entities that own pools or operate boats are responsible for observing specific laws that are designed to help prevent water-related accidents. When they fail to adhere to mandated safety laws and guidelines and someone is injured or dies because of their negligence, they can be held liable for that injury, or death.

Failure to secure access to a pool, provide adequately trained lifeguards, or protect persons from unsafe drains or diving boards makes pool owners liable for a resulting accident. Also if warning signs were not posted regarding bacteria-contaminated water or shallow water, owners are liable for a resulting illness, injury or death.

Likewise, operators of fishing, sailing and yachting boats, and jet skis are liable if an accident occurs as a result of drunk or reckless navigation or lack of life jacket use.
